Marrying a US Citizen in the USA: The Green Card Path

Couple marrying a US citizen in the USA and reviewing the adjustment of status path.

Written by the Ellis Porter content team. This article has not been reviewed by an attorney. It is general information, not legal advice.

In plain English: If you marry a US citizen while you are inside the US, you may be able to apply for a green card without leaving, through adjustment of status, if you entered lawfully and are otherwise eligible. Your citizen spouse files a petition to prove the marriage, you file the green card application, and you attend an interview. Marrying in the US does not make you a citizen and does not grant a green card automatically. How you entered and your current status decide whether you can adjust inside the country or must process through a consulate abroad.

What marrying here really means for your status

You have found your person, and they happen to be a US citizen. One of the first worries is usually simple. Can you stay put while you sort out the paperwork? Here is how it works, in plain terms.

Marrying a US citizen in the USA does not make you a citizen or give you a green card automatically. What it can do, if you are already here, is let you apply for a marriage green card without leaving. That process is called adjustment of status. Marriage to a US citizen also makes you eligible to apply for that marriage green card as an immediate relative.

Does the marriage itself make you a citizen? No, it does not. See what marrying a citizen actually gets you. For the broader process, read our main marriage green card guide.

Why marrying in the US can matter

A spouse of a US citizen is an immediate relative under 8 USC 1151, so there is no visa-number wait. The main question is often procedural. Can you get the green card inside the US, or must you process abroad?

If you entered lawfully, are physically present, and are otherwise eligible, you may be able to adjust status and stay here while the case is pending. If not, the case generally goes through a US consulate and the National Visa Center. Whether you can adjust inside the country or must process abroad depends on how you entered and your current status. Our page on adjustment of status vs consular processing explains how to tell which applies.

The in-country path, step by step

Here are the main steps for the in-country path.

  1. Your citizen spouse files Form I-130 to prove the marriage is real.
  2. You file the green card application, Form I-485, to adjust status.
  3. Your spouse signs the affidavit of support, which is Form I-864.
  4. You attend the green card interview, usually at a US office.

Many applicants file the green card application together with requests for a work permit and an advance parole travel document, so they can work and travel while the case is pending.

Adjust in the US or process abroad?

Which route is open to you is not a matter of preference. It turns on how you entered and your immigration history. Certain entries or status problems can require the consular route instead of adjustment, depending on the facts. That is worth confirming before you file. Not sure which column you fall into? That is one of the most common reasons couples talk to an attorney early. It is a normal question to have.

A caution on travel

Travel needs extra care here. If your case is pending and you leave the US without the right travel document, you can abandon the application or trigger other problems. Do not assume marriage protects a departure. Confirm any travel with an attorney first.

Citizenship is still later

Marrying a citizen in the US does not speed up the citizenship rules. You become a permanent resident first, and only after holding the green card and meeting the marriage and residence requirements can you apply for naturalization, potentially after three years. See citizenship for marrying a US citizen.

How an Ellis Porter attorney helps

The hardest part is often the eligibility question. Does your entry and history let you adjust here, or force the consular route? And how do you avoid a misstep on work or travel while you wait? An immigration lawyer for a marriage green card can confirm the right path, prepare a strong bona fide marriage record, and get you ready for the interview.

This article is general information, not legal advice, and does not create an attorney-client relationship. The right path and timeline depend on the specific facts of your case. Consult a licensed immigration attorney.

Frequently asked questions

Does marrying a US citizen in the USA make you a citizen?

No. Marrying a US citizen inside the US does not make you a citizen and does not automatically give you a green card. It makes you eligible to apply for a marriage-based green card as an immediate relative. Citizenship is a later, separate step that requires holding a green card for a set number of years and meeting other rules. Where the wedding happens does not change that.

Can I get a green card without leaving the US if I marry a citizen here?

Often yes. If you entered the US lawfully, are physically present, and are otherwise eligible, you may be able to apply through adjustment of status and stay in the country while the case is pending. This lets many spouses avoid consular processing abroad. Eligibility depends on how you entered and your immigration history, so certain entries or status problems can require the consular route instead. It is fact-specific.

What is the difference between adjusting status and going through a consulate?

Adjustment of status is the in-country process for someone already in the US who is eligible; the green card is handled without leaving. Consular processing is used when the spouse is abroad or cannot adjust; the case goes through the National Visa Center and a US consulate for an immigrant visa. Which one applies depends on your location, how you entered, and your history, not simply on preference.

Can I work and travel while my case is pending?

If you apply through adjustment of status, you can generally also request a work permit and an advance parole travel document that are issued while the green card case is pending. Until those are approved, marriage alone does not authorize work, and traveling without the right document can create serious problems for a pending case. Confirm timing and travel plans with an attorney before you leave the country.

Do we still have an interview if we marry and file in the US?

Usually yes. Marriage-based green card cases generally include an interview where an officer reviews whether the marriage is genuine and whether you are admissible. For adjustment cases the interview is typically at a USCIS office in the US. Both spouses usually attend and should be ready to show a shared life together. Preparation matters, because the interview is where a real marriage is confirmed.

Does marrying a US citizen for citizenship work faster if we marry in the US?

The location of the wedding does not speed up citizenship. First you must become a permanent resident, then hold the green card before applying to naturalize. Spouses who keep their green card and stay married to and living with the same citizen spouse can generally apply after three years rather than five. Marrying inside the US may let you adjust status without leaving, but it does not shorten the citizenship rules themselves.
