Trump Administration Appeals Travel Ban Temporary Restraining Order

At the urging of President Trump, the Department of Justice has filed an appeal with the 9th Circuit Court of Appeals seeking to overturn the District Court judge's temporary restraining order, which has halted the travel ban Executive Order nationwide.  The DOJ is arguing that the President has the constitutional power to restrict entry to the United States, and that the courts cannot second-guess his determination that such a step was needed to prevent terrorism. 

The Court of Appeals did not make an immediate decision on the DOJ's appeal, and instead instructed both parties to prepare for an oral argument before a panel of three appellate judges.
